Breaking !! Lawyers file lawsuit against NBC over punitive fines against Arise TV, Channels and AIT

 Some Nigerian legal advisors under the aegis of Digital Rights Lawyers Initiative (DRLI), have documented a suit against the National Broadcasting Commission over the supposed correctional fines forced on AIT, CHANNELS and ARISE TV. 



Review LIB announced that the NBC endorsed the TV slots for supposedly disregarding the transmission code, top of which is the utilization of mysterious online video recordings via web-based media. They were blamed for broadcasting unconfirmed pictures of the supposed shooting which occurred at Lekki cost entryway. 


In the claim recorded against the NBC, the legal advisors are looking for "presentation of the fines as a stiffling impact against opportunity of articulation, an interefence with the TV channels option to get thoughts and data without obstruction, a never-ending directive against the NBC from forcing authorizations or fines or extreme, unbalanced, unlawful and to be sure illegal limitations on TV slots among different requests." 


The claim which was recorded by the association's legal counselors, Solomon Okedara and Olumide 


Babalola is looking for the accompanying reliefs under the watchful eye of the government high court in Abuja; 


I. A DECLARATION that the Respondent's subjective demonstration of authorizing and forcing fine of Three Million Naira (N3,000,000) on every one of ARISE TV, CHANNELS TV and AIT purportedly in accordance with Sections 5.6.3 and 5.6.9 of the Nigeria Broadcasting Code makes a chilling or smothering impact on opportunity of articulation and is probably going to meddle with the privilege of 


the Applicant's individuals to opportunity of articulation, especially, their entitlement to get thoughts and data without obstruction as ensured by segment 39 of the Constitution of the Federal Republic of Nigeria, 1999 (as changed) and Article 9 of the African Charter on Human and Peoples' Rights (Ratification and Enforcement) Act (Cap A9) Laws of the 


League of Nigeria, 2004. 


ii. A DECLARATION that the fine of Three Million Naira (N3,000,000) forced on every one of ARISE TV, CHANNELS TV and AIT in fact comprises an impedance to the Applicant's individuals' entitlement to opportunity of articulation, especially, their entitlement to get thoughts and data without obstruction ensured by area 39 of the Constitution of the Federal 


Republic of Nigeria 1999 (as corrected) and Article 9 of the African Charter on Human and Peoples' Rights (Ratification and Enforcement) Act (Cap A9) Laws of the Federation of Nigeria, 2004. 


iii. A DECLARATION that the respondent not being a legal body does not have the ability to force fines on any telecaster, including fines forced on ARISE TV, CHANNELS TV and AIT and the inconvenience of such fines is invalid and void. 


iv. A CONSEQUENTIAL ORDER of putting aside the fine of Three Million Naira (N3,000,000) forced on every one of ARISE TV, CHANNELS TV and AIT as same was unlawfully forced. 


v. A PERPETUAL INJUNCTION limiting the Respondent, its officials, operators as well as agents from forcing approvals or fines or exorbitant, lopsided, unlawful and undoubtedly illegal limitations on TV slots including ARISE TV, CHANNELS TV, AIT and other TV or radio broadcasts which will meddle with the Applicant's individuals' entitlement to opportunity of articulation, especially, their entitlement to get thoughts and data without obstruction. 


vi. AN ORDER of grant of aggregate of One Million Naira in particular (N1,000,000) to the Applicant as the expense of this activity. 


vii. Also, SUCH OTHER ORDER (S) as this respectable Court may consider fit to allow in the situation.
